The victim killed in a multi-car collision in Austell last month has been identified by Cobb Police.
The suspect charged with causing the fatal collision is a 38-year-old man from Antioch, Tennessee. He has been charged with homicide, as well as other offenses such as failure to maintain a lane and driving with a suspended license.
According to police reports, the incident occurred around 3:30 p.m. on July 16 when the driver of a 2018 white GMC Sierra was reaching for his phone while traveling south on Hicks Road. The Sierra crossed the centerline and collided with a black GMC Yukon heading north, causing it to overturn onto its side and come to rest on the shoulder of the road.
Behind the Yukon was Debbie L. Bates in her silver Ford Escape, which was pushed into a guardrail over a creek upon impact with the Sierra. Police also report that the driver of a grey Hyundai Sonata was behind Bates at the time of the collision, and both drivers sustained visible injuries and were taken to different hospitals for treatment.
Sadly, Bates sustained fatal injuries and was pronounced dead at the scene.
A warrant has been issued for Earl’s arrest and anyone with information about him or the collision is urged to contact Cobb police at 770-499-3987.
CRASH INVESTIGATION
In 2018, nearly 3,000 fatal accidents occurred from distracted driving, according to the Insurance Information Institute. That is 5.2 percent of the total number of fatal accidents. Activities that lead to a driver’s inattention include talking or texting, eating, talking with passengers, and adjusting vehicle controls, among others, said Candice Bond, a Managing Partner with Bond Legal.
WRONGFUL DEATH CLAIM
